This Privacy Policy sets forth VidaNow, Inc. ("we", "our" or "us") policies and procedures regarding the collection, use and disclosure of Your information in connection with Your use of the Vida application (the "App") and any associated services, features, content, or applications we offer through the App (collectively, the "Services").

What Does This Privacy Policy Cover?

This Privacy Policy explains the treatment of personally identifiable information ("Personal Information") gathered when You are using or accessing the Services. This Privacy Policy also covers our treatment of any Personal Information that our Business Partners share with us or that we share with our Business Partners.

This Privacy Policy only covers our use of Your information. It does not apply to the practices of third parties that we do not own or control, such as any third party websites, services and applications (e.g., Twitch, YouTube, Google, Twitter, Facebook, Instagram, etc.) (each a "Third Party Service") that You may make use of when using the Service.

What Information Do We Collect and Use?

Account Information

If You create an Account on the Services, You may be required to provide information that could be Personal Information, such as your name, phone number and/or email address. If you register for or access the Services using a Third Party Service (such as your social media account login credentials), we may receive Personal Information that you allow such Third Party Service to share with us.

Information Regarding Third Party Services

You may interact with third party applications while using the Service. By interacting with or using these Third Party Services, your interactions with those Third Party Services are subject to the Third Party Service's privacy policy. Additionally, we may collect and receive your social media account login credentials to provide you with the Services, but only if you expressly provide us with such information.

Personal Information Retention

We keep your information for no longer than necessary for the purposes for which it is processed. The length of time for which we retain information depends on the purposes for which we collected and use it and/or as required to comply with applicable laws.

Location Information

Some of our Services may include features based on users' actual locations and may report on users' current locations ("Location-Based Services"). To the extent you opt to use any Location-Based Services, we may collect and store information about your location at the time you use those Location-Based Services.

IP Address Information and Other Information Collected Automatically

We automatically collect usage information, such as the number and frequency of visitors to the App and users of the Services. We may collect some device-specific information if you access the Services using a mobile device, including unique device identifiers, network information, and hardware model.

Email, Text, and Push Notification Communications

We may communicate with you via push notification, email, SMS, MMS or other text message (to the extent you permit us to do so), and we may collect information regarding such communications, such as confirmation when you open an email or receive a push notification.

Children's Privacy

We do not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If we become aware that we have collected personal information from a child under the relevant age without parental consent, we take steps to delete that information.

How Is My Information Used and Shared?

Public Information About Your Activity

Some of your activity on and through the Services is public. Public activity may include content you have posted publicly on, through or in connection with the Services, including public portions of Third Party Services, such as your social media accounts.

Aggregate and Non-Personally Identifiable Information

We share Aggregate Information with our partners, service providers and other persons with whom we conduct business, such as social networks ("Business Partners"). We may also share information with our Business Partners that is not Personal Information or has been anonymized.

Information Shared with Our Agents

We employ and contract with people and other entities that perform certain tasks on our behalf and who are under our control (our "Agents"). We may need to share Personal Information with our Agents to provide products or services to you.

In some cases, we may choose to buy or sell assets. In these types of transactions, user information is typically one of the transferred business assets. Moreover, if we, or substantially our assets, were acquired, or if we go out of business or enter bankruptcy, user information would be one of the assets that are transferred or acquired by a third party.

We seek to protect Account information to ensure that it is kept private; however, we cannot guarantee the security of any Account information. We store all of our information using industry-standard techniques. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of user information at any time.

How Can I Exercise My Data Protection Rights?

If you are a registered user, you can access and update certain information with your Account by logging in and visiting the profile or settings section. Any user can limit our use of their mobile device identifier by visiting the privacy settings of their mobile device.

California Privacy Rights

California law permits users who are California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed their personal information (if any) for their direct marketing purposes in the prior calendar year. How Can I Delete My Account?

Should you ever decide to delete your Account, you may do so through the App by deleting the App or by emailing team@vidanow.io. If you terminate your Account, any association between your Account and information we store will no longer be accessible through your Account.

What Choices Do I Have Regarding My Information?

You may, of course, decline to submit information through the Services, in which case we may not be able to provide certain services to you. You can delete your Account or choose to opt out of certain communications or communication methods.

What Happens When There Are Changes to this Privacy Policy?

If we change our privacy policies and procedures, we will post those changes on this page. If we make any changes to this Privacy Policy that materially change how we treat your personal information, we will endeavor to provide you with reasonable notice of such changes.
